扶助贫困法定许可制度探究

摘　　要：为了实现我国可持续发展,提高贫困地区的经济和文化发展水平,有必要建立扶助贫困法定许可制度,公共利益理论是该制度建立的法理基础。在具体制度构建上,该法定许可使用应以扶助贫困为目的,许可使用的地域范围、受众、作品应予以明确并做出一定的限定,使用方式不受限制,网络环境下的使用人应采取技术措施防止其他人接触和使用作品。For the purpose of realizing sustainable development of our country, promoting the level of economic and culture development in poverty-stricken areas, it is indispensable to establish statutory license system for poverty alleviation. Public interest theory is the jurisprudence basis to build it. In the respect of concretely establishing the system, the purpose of using statutory license should be poverty alleviation. Meanwhile, the territorial scope of the use, the audiences and works should be confirmed and limited. But the ways of the use should not be limited. At the same time, in network environment, the users should adopt technical measures to prevent other person from contacting and using the works.
