摘　　要：独立权利要求确定了专利权的最大保护范围,从属权利要求的保护范围较小且在独立权利要求的保护范围之内。独立权利要求被宣告无效后,其直接从属的权利要求就上升成为了独立权利要求。在专利权的权利要求被宣告部分无效的情况下,应当以每一项被维持有效的权利要求记载的技术特征,与其引用的权利要求记载的技术特征,共同确定专利权的保护范围,不能因所引用的权利要求无效而限制维持有效的权利要求的保护范围。Independent claim confirms the maximum rang of the protection, while dependent claim at a smaller rang of protection and in the scope of protection of independent claim. After independent claim being declared null and void, its dependent claim becomes independent claim. In the case of being declared invalid, the scope of protection should be based on each technical feature of the records which is maintained effective and referred, cannot limit the scope of the protection of maintain effective claim because of its invalid reference.
