附随义务涵义和价值理念的探析

摘　　要：附随义务在目前仅是一个学理概念 ,且缺乏系统研究。作为一个法律术语 ,在国内、外的相关法典或判例中均没有明确的概念 ,但其具体内容在各国立法中均有所体现 ,并在合同法领域起着重要的作用。因而 ,界定附随义务的涵义 ,理顺合同缔结、履行中的义务关系 ,以实现附随义务保证交易安全与快捷的价值理念。For the time being ,collateral obligation is only referred to as a theoretic concept which lacks systematic study. As a legal term, it has no explicit definition in relevant codes or precedents in civil or international countries .Notwithstanding the above ,the detailed description of collateral obligation are well embodied in legislation of every nation, hence significant in its role in the scope of Contract Law. We should understand its implication and coordinate obligations in concluding and performing contracts so as to realize the value of collateral obligation,which is guarantee of safe and prompt transaction.
