摘　　要：公用征收具有行政法与民法的双重属性,其内部存在权力──义务和权利──义务两种法律关系。要规范国家权力的运行,就应该对公用征收决定权进行科学的配置;要建立科学合理的财产权保护制度,就必须明确公用征收补偿的原则、标准及程序。The public expropriation is of dual attributes of administrative law and civil law, its exists power-obligation and right-obligation legal relationship. To standardize the operation of state power,we should dispose the expropriation decision scientifically; To establish a scientific and rational system of protecting property rights, We must define the principles, standards and procedures of expropriation compensation.
