基于知识链的产学研合作中知识产权问题研究

摘　　要：从知识链的角度对产学研合作中的知识产权问题进行研究。首先分析产学研知识链中知识搜寻、知识转移、知识吸收再创新、知识市场应用等4个环节的知识流动特征,然后研究产学研知识链的各个环节引发知识产权冲突的原因,最后提出应制定相对完备的合作契约、加强企业和学研方之间的诚信培植、建立有利于知识流动的绩效评估和激励机制以及进一步探索产学研合作的新模式,才能更好地化解知识产权冲突,提高知识流动效率。In this paper the intellectual property problems in the cooperation among industry, university and research based on knowledge chain were studied. At first, the five features of knowledge flow, knowledge searching, knowledge transferring, knowledge absorption and recreation, knowledge market, etc. , were analyzed. Then the intellectual property conflicts and its inducing reasons throughout the links of the industry, university and research chains were studied. Finally we proposed that to better resolve the intellectual property conflicts and enhance the efficiency of the knowledge flow, a relatively complete cooperation agreement should be signed; the built credits of the two innovation bodies should be enhanced; the regulation to benefit the working evaluation and encouragement mechanism should be established; the new mode for the cooperation among industry, university and research should be explored.
