从实际案例浅谈“放弃式”修改是否超范围的判断

摘　　要：具体放弃是一种特殊类型的修改方式,主要出现在化学领域以及涉及数值范围的修改。《专利审查指南》对于涉及数值的放弃式的修改是否超范围的问题做了规定,《审查操作规程》中也对具体"放弃"式的修改进行了补充说明和解释。但是在实际审查过程中,如何判断何为"放弃"式的修改,以及判断该"放弃"式的修改是否超范围一直是个难点和热点问题。尤其对于非数值式的"放弃"式的修改是否超范围的判断《专利审查指南》,《专利审查指南》和《专利操作规程》中并没有相应的处理方法,根据一个实际案例的审查以及复审过程浅谈关于"放弃"式修改是否超范围的判断。The specific disclaimer is a special type of modifications, which mainly exists in the field of chemistry, as well as modifications related to the range of values. 《 Guidelines For Patent Examination》 provides a prescript whether the disclaimer modifications involves value going beyond the scope of the disclosure. 《 Patent Examination Operation Rules》 provides the supplement and explain for the disclaimer modifications. However, in actual examination process, how to dctermine what is disclaimer modifications and whether it goes beyond the scope of the disclosure have been a hot and difficult problem, espe- cially for the non -value types modification. Either the 《Guidelines For Patent Examination》 and the 《Patent Examination Operation Rules》 provides correspondirrg operation. A real patent case is refered and the determinant of whether the disclaimer beyond the scope of the disclosure is discussed.
