摘　　要：随着中哈两国间政治、非资源经贸和人文交往关系的不断深化与巩固,两国间延续20年的石油合作无论是在勘探开发、还是在油气贸易、石化产品生产、输油管道建造与营运等方面都取得了较大的成效而堪称中亚地区能源合作的典范。但是伴随着两国石油合作范围、规模的不断扩大,合作法律机制保障不足的问题日显突出,并在地区变幻莫测的复杂环境条件下有导致双方合作不畅或引发合作停顿、萎缩等隐患,是两国经济与能源安全的潜在威胁之一。分析介绍了中哈石油合作法律机制建立的背景、取得的成绩和存在的主要问题,讨论了完善这一机制的可行性,并从国内法、双边条约和区域性制度等层面提出了完善对策,以期为中哈间务实、高效、持久的石油合作提供制度性建设意见与建议。With the Chinese and Kazakhstan between in political, trade and humanities exchanges between non resources continues to deepen and consolidate, oil cooperation between the two countries lasted 20 years both in terms of exploration and development, or in the oil and gas trade, petrochemical production, oil pipeline construc- tion and operation has made great achievements and exemplary energy cooperation in Central Asia area. But with the oil cooperation between the two countries, the scope of the continuous expansion of the scale, the cooperation mechanism of legal protection of inadequate problems, complex environment and in the area of cooperation between the two sides has led to change unpredictably or poor triggered cooperation pause, atrophy and other dangers, is one of the potential threat of bilateral economic and energy security. This paper introduces the background, has estab- lished the Sino Kazakh oil cooperation legal mechanism of the achievements and existing problems, discussed the feasibility of perfecting the mechanism, and put forward the countermeasures from the national, bilateral treaties and regional system level, provide the opinions and suggestions of construction of system in order to Kazakhstan be- tween pragmatic, efficient, durable oil cooperation：
