军人退役安置制度完善研究

摘　　要：军人退役安置行为的性质决定了军人退役安置制度的理论基础及具体制度选择。只有正确认识军人退役安置行为性质,才能合理构建其理论基础和反思目前军人退役安置制度及相关政策的妥当性。理论界主流观点认为,军人退役安置行为性质是社会保障行为。从法学角度而言,将军人退役安置行为性质定位成社会保障行为不仅有悖社会保障的概念和制度功能,而且也不符合现行相关法律规定。义务兵退伍安置行为性质是一种国家补偿,而军官转业安置行为属于国家机关内部工作调整。相应地,军人退役安置的理论基础应当根据分类不同而有所区别,在提高退伍义务兵补偿安置标准的同时,严格控制军官转业安置的规模和数量,进一步提高军官平时服现役的最低年限,逐步实现军官的职业化。The behavioral nature of the ex - serviceman＇s arrangement in china is the source of the theoretical basis and the system choice. If we can grasp the behavioral nature of the ex- serviceman＇s arrangement in china, it is possible for us to construct its theoretical basis and introspect the related system. Many scholars believe that the behavioral nature of the ex -serviceman＇s arrangement in china belongs to the social security system. The major view is against the connota- tion of the social security system , its function and the related system. The author thinks the veter- an placement belongs to the state compensation, and the ex -service policies on military officers are to change their posts. Accordingly the theoretical basis differs from the others. On the one hand the state should to improve the standard of the state compensation, on the other hand the number of retired officers should be decreased. It is advocated to improve the fixed number of service years in a short time. Finally the military officers professionalism would be established in china.
