摘　　要：建立上合组织能源俱乐部既有成员国间合作的客观条件和主观愿望,也有地缘政治的利益驱动;既有成员国维护能源安全和发展经济的向心力,也存在着控制、干扰、甚至是分化的阴霾。其性质应当与一般区域性政府间组织无异,在维护全球能源安全中发挥应有的作用。该俱乐部组建文件或基本法律依据应当称为《章程》而非政府间协议的任何名称,需要明确两个问题:一是该章程得以成立或有效的法律依据问题;二是该章程的内容,即该俱乐部的基本规则问题。The setting up of SCO energy club emerges from the objective conditions and subjectivewishes of member state cooperation and geopolitical drive, and the centripetal force of the member statesin safeguarding energy safety and economic development and the existence of control, interference and evenpolarization. It is, by nature the same as any other general regional governmental organizations and shouldfunction in safeguarding global energy safety. Two points must be made clear in setting up this club： thelegal basis for the formulation and effectiveness of its regulation, and the content of the regulation, i.e., thebasic rules of the club.
