摘　　要：非物质文化遗产的传承主要依靠人与人之间的口耳相传,其中传承人发挥着重要作用。因此,如何调动传承人对非物质文化遗产保护的积极性就成为非物质文化遗产保护的重要内容。然而,我国《非物质文化遗产法》对传承人的规定较为简单,只是从义务的角度规定了传承人的传承义务,导致传承人保护非物质文化遗产的积极性不高。对此,应当加强传承人对非物质文化遗产传承的权利性认识,在立法中明确规定传承人享有非物质文化遗产传承权,通过程序性规定和法律救济措施的制定进一步保障非物质文化遗产传承人作为权利主体对传承活动所享有的传承权。The inheritation of intangible cultural heritage is mainly depended on word of mouth between men, in which the inheritor plays an important role. Hence, how to arouse the enthusiasm of inheritor to the protection of intangible cultural heritage becomes the imporatant content of the protection of intangible cultural heritage. However, the regulation on inheritor in the “Intangible Cultural Heritage Act” is too simple in China, which only regulates the inheriting obligation of the inheritor from perspective of obligation, and leads to lower enthusiasm of inheritor to protect intangible cultural heritage. For that matter, the right awareness of inheritor on the inheritation of intangible cultural heritage should be enhanced, the inheriting right of intangible cultural heritage enjoyed by the inheritor should be regulated clearly in legislation, and the inheriting right to inheriting activities enjoyed by the inheritor of intangible cultural heritage as right subject should be further protected through the stipulation of procedural regulation and legal remedy measure.
