摘 要:首次销售原则是版权法上的一项重要原则,数字环境下该原则的适用性问题成为当前版权法律与实践的热点与难点问题。所有还是许可、复制还是发行的法律争议并不构成数字化首次销售原则的根本性法律障碍;平衡数字环境下版权人与版权消费者之间的利益冲突、回应数字文化产业发展趋势,都需要明确澄清该原则的适用性问题,相关技术发展亦为解决该问题提供了一定的技术支撑。As an important principle in copyright law, the first sale doctrine is increasingly becoming a hot topic in copyright law and related legal practice, especially in digital environment. The question of "own or license" and the question of "copy or publish" are not the essential obstacles in the application of the first sale doctrine in digital environment. The application problem of the first sale doctrine in is very important for solving the conflict of benefits between right holders and consumers in digital environment and making a response to the development trend of digital culture industry. What's more, some related technologies will also provide technological support for solving that problem.
