山西省科技法规政策体系问题研究

摘　　要：中国国家科学和技术委员会法律制度的一个重要组成部分就是地方科技立法,它是对国家立法的细化,同时也起到补充和完善国家立法的作用。文章简要介绍在国家的科技法规基础上的山西省科技法规制定的发展历程,论述山西省通过建立执法责任制确定了执法范围和执法主体,落实了执法责任。但是,效率低,缺乏可操作性、前瞻性和具体的法律法规,则是地方科技立法存在的明显不足。只有通过架构适合的科技法规政策体系,通过地方法律法规与国家法律法规政策相结合,才能推动高新技术在新机制下的稳步发展。The local legislation for science and technology,as an important component of legal system stipulated by the State Commission of Science and Technology,not only specifies the national legislation,but also supplement and improve its function. In this article,the development of the legal system for science and technology,which is made on the basis of the national legislation is imtroduced,and the scope and the subject of the law enforcement is expounded. And then some problems like the low efficiency,and lack of operationability,forward-looking and specific regulations are pointed out. Finally,the conclusion is reached that only by way of constructing an appropriate legislation system for science and technology,and integrating the local and national rules and regulations,can the high and new technology be steadily promoted under the new system..
