摘　　要：离婚财产清算是亲属法中的基本制度,《婚姻法》仅作了原则性规定。从司法实务入手,分析离婚财产清算制度的适用现状、实践效用与立法局限,有助于在比较分析、价值分析的基点上,实现离婚财产清算制度的立法完善与适用正义。《婚姻法》有关离婚财产清算的制度选择须依遵如下路径:分割夫妻共同财产应坚持公平分割的原则,以协调夫妻共同财产分割与家务贡献补偿的矛盾;清偿夫妻共同债务应坚持共同清偿的原则,以协调夫妻的共同债务与个人债务的清偿与追偿的矛盾,进而实现保障人格尊严、追求性别关怀、崇尚意思自治、维护婚姻秩序、促进社会公正的价值追求。The liquidation of divorce property is the basic system of law of domestic relation, for which there are only some principled provisions in China＇ s current marriage law. This paper starting from judicial practices analyzes the application situation, practical efficiency and legislation limitation of the divorce liquidation system, which can contribute to pursuing and realizing the legislation perfection and application justice of the divorce property liquidation system on the basis of comparative analysis and value analysis. The system choice concerning divorce property liquidation in China＇ s current marriage law shall be abided by the following paths ： the principle of fair division shall be adhered to in the division of couple＇ s common property, in order to coordinate the contradiction of couple＇ s common property division and household contribution compensation; the principle of common settlement shall be upheld in couple＇ s common debts settlement, in order to coordinate the contradiction of settlement and recovery of couple＇ s common debts and individual debts, and then realize the value pursuit of safeguarding personal dignity, pursuing gender care, advocating autonomy of will, maintaining marital order and promoting social justice.
