短期自由刑执行机制改革研究——以社区矫正制度的完善为视角

摘　　要：针对短期自由刑的弊害,从我国刑事政策的调整背景出发,依托刑法修正案(八)对社区矫正制度的正式确认,将短期自由刑的执行通过缓刑制度与内容严谨的社区矫正制度做一体化设计,既保留了刑罚威慑力,又符合行刑社会化原则,顺应了宽严相济刑事政策的要求,是一种有益和可行的思路。社区矫正制度的完善和缓刑机制的合理化构建是一体化改革的关键。In view of the defects of short - term freedom penalty, taking official confirmation of community correction into the Amendment of Criminal Law（8） as an opportunity, integration reform of short -term freedom penalty and standardized and well - structured community correctioncan be made. Therefore,it＇ s beneficial and feasible to establish such a reform pattern that suits both national conditions and criminal policy of tempering justice with mercy. Well - structured community correctioncan and suspended sentence system are key factors of integration reform.
