摘　　要：马克思主义法学产生有其特定的政治、经济和思想背景,这些背景决定了马克思主义法学的批判性与革命性。在全球化背景的当下,马克思主义法学暴露出了一系列困境。它揭示了现代法律的"阴谋",但同样也面临"正义"标准的缺失、全能政府与社会治理之间的抵牾、法律在经济基础和上层建筑之间的徘徊不定、法律未来走向的含混与迷茫等困境。针对这些困境,马克思主义法学正在完成由批判的马克思主义到建构的马克思主义转变。Marxism Law has its special politics , economics and ideology backgrounds .These backgrounds have decided the characteristic of criticism and revolutionary of Marxism Law .When facing the globalization back-grounds , it exposed a series of difficulties .It reveals the conspiracy of the modern law , but it also facing the diffi-culties such as lacking the standards of justice , the conflicts between omnipotent governments and social govern-ance, law is the economic foundation as well as the superstructure , the future direction is confused of the law .A-gainst these difficulties , Marxism Law is experiencing criticism to constructivism .
