合作治理下政府与民间组织关系的法理探析——以宁波市政府“居家养老服务体系”项目为例

摘　　要：文章通过对宁波市政府"居家养老服务体系"项目运行中政府与民间组织关系的实证分析得出:在社会结构日益多元化背景下,不同类型的民间组织参与社会管理的不同形式而生成政府与民间组织不同互动关系的"合作治理"模式,需要重新定性政府与民间组织之间的法律关系;需要用"软法"来规范"合作治理"中政府和民间组织的法律行为;政府应通过提供多元的公共服务供给机制、有力的资金保障、科学的民间组织培育机制和监管评估执行来消除民间组织参与公共服务领域的制度性障碍,使民间组织更加规范,同时也使自己的行为更负责任。An empirical analysis of the relationship between the government and non-governmental organizations in ＂home care service system＂ of Ningbo indicated that when social structure gradually diversifies, different types of non-governmental organizations participated in social governance and different cooperative governance models came into being. It is necessary to redefine the legal relationship between the government and non-governmental organizations, and adopt ＂soft law＂ to regulate the legal act in cooperative governance. Government should provide diversified public service supply mechanisms, strong financial guarantee, reasonable cultivation mechanism and effective supervision and evaluation mechanisms for non-governmental organizations to eliminate the institutional barriers in participating in public services, which therefore not only make the non-governmental organizations more standardized but also make their own act more accountable.
