司法独立与检察功能的转化

摘　　要：司法公正是我国司法改革的目标 ,司法独立是司法公正的保障 ,而司法独立的实现需要检察功能的重新定位。长期以来 ,我国检察机关功能庞杂、效益低下 ,不能适应现代刑事诉讼的要求 ,理应随着刑事诉讼制度的变革作相应的改革 ,加强其侦查功能和控诉功能 ,同时将其司法审判监督功能剥离出来 ,移交人大机关。Judicial justice is the goal of our judicial system reform, and independence of judicature is its safeguard ,while the realization of judicial independence needs reorientation of Chinese procuratorial function .For a long time, the numerous and jumbled functions and the poor efficiency of the procuratorial organization can't adapt to the requirement of modern criminal system, so its function should be reformed with the development of the reform of criminal mode .The functions of investigation and accusation should be reinforced ,while the functions of adjudication and superintendence should be transferred to the organization of the people's congress.
