摘 要:非法用工单位的提法由工商行政管理法规相关规定衍变而来,被移植于劳动法中作为区别于用人单位的一个专有概念使用,并以此构建非法用工单位伤亡人员一次性赔偿制度。该制度以对"用人单位"范围的界定来判断务工人员是否具备"劳动者"身份,从而在实质上剥夺了非法用工单位职工获得工伤保险保障的权利。相对于工伤赔偿,非法用工单位一次性赔偿制度在法律及理论依据、法律实施社会效果等方面存在诸多不足。因此,对非法用工单位职工发生事故伤害处理的最佳方式,应是废除一次性赔偿制度,统一实行工伤赔偿。The idea of illegal employment come from the prescribed of the industrial and commercial administrative 'laws and transplanted in labor law as a proprietary concepts which distinguished from employing unit, and on the basis of this construct the lump-sum compensation system to the disabled or deceased employees of entities involving illegal employment. The system according to the definition of “employing unit” to judge whether workers have “laborers” identity, which substantially to deprive the right of industrial injury insurance of workers' in illegal employment unit. Relative to industrial injury / compensation, lump-sum compensation system to the disabled or deceased employees of entities involving illegal employment has some shortcomings: law and theory basis, law enforcement social effect and so on. So the best way to deal with the works' accident injury in illegal employment unit is to abolish the lump-sum compensation system and implement unified industrial injury compensation.
