摘　　要：自新中国成立以来,指向慈善组织的慈善立法经历了"排斥—借力—接纳"的基调演变过程。这一演变过程以慈善组织登记管理制度演变为明线,体现了慈善组织官方化、行政化的特点;以政府职能演变为暗线,作为立法基调演变的内在原因,体现了慈善组织民间化、市场化的特点。2006年后,我国进入了慈善立法的新阶段,综合性的慈善法呼之欲出,而慈善组织的生存土壤面临着行政化与市场化之间的发展困境。Since the founding of New China, the charitable legislation towards the charitable organization has gone through an evolution process of ＂rejection-leverage-admission＇. The process is distinctly based on the change of registration system, which indicates the officially and administration features of the charitable organization. Meanwhile, the transformation of government function, as the immanent cause of the legislation evolution, obliquely reflect the privatization and marketization of it. After 2006, China stepped into a new stage of charitable legislation. And the comprehensive legislation is coming out, however, the survival of charitable organization confront with a conflict between administration and marketization.
