摘　　要：中国古代存在刑事附带离婚制度。《唐律疏议》第一次对这一制度作了较为全面的规定,共涉及十一条律条。涉及的犯罪包括为婚妄冒、有妻更娶、居父母夫丧嫁娶、同姓为婚等等。确立这一制度的主要原因是这类犯罪行为违反了婚约、触犯了家庭和家族伦理、有违等级制度等等,因此不仅要追究犯罪人的刑事责任,还要附带离婚,不让这种婚姻持续下去。《宋刑统》全盘继承了《唐律疏议》的规定。《大明律》对《唐律疏议》的规定作了较大改变,其中包括增加了一些内容、调整了一些内容、改变了一些用刑和一些用语等。《大清律例》沿革《大明律》的规定,只是在律条后附上了例条。从中还可见《唐律疏议》的刑事附带离婚制度对后世影响之大。进入20世纪以后,随着全国范围内的大规模法制改革,刑事附带离婚制度也退出了历史舞台。The article is to prove that there is the system of criminal litigation with incidental divorce action in ancient China. For the first time, The Tang Code with Commentaries had rela- tively comprehensive provisions on this system, and 11 articles hereof are related to the system, including such crimes as getting married without a matchmaker, bigamy, getting married during the mourning for one parents or husband, isonymous marriage, etc. The major reasons for the establishment of this system are because these crimes are against the marriage promises, family and clan ethics, and the hierarchical system. The offender thus needs not only to take the crimi- nal responsibility but also to be filed against the incidental divorce action to terminate the mar- riage. The Criminal Law of Song Dynasty wholly adopted the relevant provisions in The Tang Code with Commentaries. The Great Ming Code made relatively significant changes on The Tang Code with Commentaries, which include some additions, adjustments and some changes on pen- alties and terms. The Great Qing Code almost preserved the relevant provisions in the The Great Ming Code, and the main alteration was that some edictal provisions were added after the statuto- ry provisions. It can also be seen that the system of criminal litigation with incidental divorce action in The Tang Code and Commentaries has a great influence on the law in later generations. After entering into the 20th century, the system of criminal litigation with incidental divorce action stepped down from the stage of history.
