“常回家看看”条款在司法适用性方面之检讨

摘　　要："常回家看看"入法,折射出当今我国老年人权益保障的突出问题,使老年人的诉求变得有法可依。然而,在司法实践中,条款概念界定的模糊、监管与取证的困难和法院裁决与执行的随意导致司法判决和执行的困惑。国外在老年人合法权益保障上的成功经验值得我们学习和借鉴。后续我国的司法实践中,急需出台相关司法解释,强化政府职责,落实带薪休假制度,明确立法深意。Adding ＂Going Homo Often＂ into law presents the problems in the rights protection of the aged in our country and provides law for the elderly to resort to for their demands. In juridical practice, however, some puzzles still exist due to the indistinetion of the article, the difficulties in obtaining evidence and the adjudication and the arbitrary law enforcement by the court. Some relative judicial interpretations and measures are in urgent need with the reference of the foreign experiences which can help to get a more definitude meaning of the legislation.
