论大学有序结构与政府干预的合理性

摘　　要：大学有序结构是自发秩序与计划秩序双向建构的产物,自生自发的高等教育系统正日益体现出计划和指令的特点。维护自发秩序、实现公共利益是政府干预的合理性所在。然而,学术自由的自发秩序是政府计划秩序不可触碰的底线,政府干预要在理智原则的引导下对大学加以适法性监督。University order structure is a product of both spontaneous and arranged orders, and the spontane- ous higher education system is reflecting the characteristics of planning and ordering. Maintaining the sponta- neous order and realizing the public interests are the rationality of the government intervention. However, the spontaneous order of academic freedom is the baseline that government arranged order should not touch. The government intervention should be carried out with its legal supervision based on the rational principles.
