民用资源征用主体立法完善

摘　　要：我国现行法律对民用资源征用主体的规定不一致,在学术上也存在不同理解。需要正确区分征用主体与征用权主体;明确主体行使的征用权具有军事权和行政权的二元属性;肯定军队在特殊情况下具有一定的民用资源征用权。Some variances exist not only in the standing laws but also in the academe on the requisition subjects of civilian resources .It is very necessary to distinguish clearly the requisition subjects and the right holder of requi-sition.We should recognize that the right of requisition embodies both military and administrative characteristics , and acknowledge the exertion of civiliian resources requisition by the armed forces under some Specific circum -stances .
