摘　　要：现代大学制度的合法性在于它创建与创新的路径依赖于历史传统的渊源、文化发展的共生、大学内外的制度环境和学术道德的恪守,在高等教育市场化中大学不能冲破学术道德和学术尊严的底线,在理想与现实的博弈中创建与创新现代大学制度。The legality of modern university system lies in the paths of its creation and innovation dependent on the origin of the historical tradition, development of cultural symbiosis, university internal and external system environment and academic ethics and abide by the university people,during the marketization of higher education, university and university people can＇t break the line of academic morality and dignity, in the game of ideal and reality, create and innovate the modern university system.
