摘 要:科学的行政规划可以起到优化社会资源配置、科学设定发展目标、有效提高行政效率和积极引导行政相对人的积极作用,是促进低碳技术应用的重要手段。我国低碳技术应用规划体系已初步形成,但却存在诸多问题,在很大程度上可归因于低碳技术应用规划在法律规制上的不完善。本文以《节约能源法》、《可再生能源法》、《清洁生产促进法》和《循环经济促进法》这四部我国最重要的低碳技术应用立法为样本,分析了我国低碳技术应用规划的法律规制情况,并重点从规划权限、实体制度和程序机制三个方面进行了论述,在此基础上提出了有针对性的完善建议。Administrative-planning is an important means to promote the application of low-carbon technologies. Scientific administrative-planning can optimize the allocation of social resources, set good development goals, improve administrative efficiency and guide the administrative counterpart's action. Although application of low-carbon technology planning system has initially formed in our country, there are still many problems. And it can be attributed to the imperfect planning system largely. In this paper, the author will take "Energy Conservation Law", "Renewable Energy Law" "Clean Production Promotion Law" and "Circular Economy Promotion Law" which are the most important application of the relevant legislation as a sample of low-carbon technologies, to analyze the situation of the legal regulation of low-carbon technology planning. Meanwhile, further emphasis on discussing the limits of planning authority, substantive content and planning process will be dis cussed. Finally the author will propose targeted advices to improve the low-carbon technologies plan ning system.
