摘　　要：明确以土地发展权的形式调整土地发展增益是大势所趋。我国土地征收中土地发展权的制度缺失主要体现在：土地发展权的补偿制度不到位；土地发展权的征地程序不规范；土地发展权的市场机制不完善。基于土地发展权保护被征地农民的权益，应建立和完善基于土地发展权的补偿制度、征地程序和交易市场。Adjusting the land development rights in the form of land development right represents the general trend. Lacking of land development right in land acquisition is mainly reflected in the following aspects： compensation system of land development right is not in place; the land requisition procedure of land development right is not standard; the market mechanism of land development fight is imperfect. We should establish and perfect compensation system, land requisition procedure and trade market of land development right to protect the expropriator＇s rights.
