论西部大开发的法治保障

摘　　要：作为现代意义的区域开发，西部大开发为当代中国法律发展及其研究提出了许多新的问题，也注入了新的活力。无论是中国自古以来开发西部的历史经验教训，还是中国当前面临的诸多现实问题，都要求西部大开发必须树立法治观念，遵循法治原则，并借鉴国外区域开发的法治机制。为此，要建立法治化的开发机制；健全西部市场经济法律机制，实现宏观调控与市场机制的有机结合；依法调整各方利益关系，形成统一领导、协同发展的良好局面；依法保护和建设生态环境，实现可持续发展；依法实施科教兴国战略，培育西部地区自我发展的良性机制。同时，要建立西部开发的基本法律规范，并逐步改革相关的立法体制、司法体制和法律服务机制。The development of western China has raised many new qu estions for as well as injected new vitality into the development of contemporar y Chinese law and the research thereof. Both the historical experiences in devel oping the West and the realities of the contemporary time demand that, in the pr ocess of developing the West, China must establish the sense and abide by the pr inciple of the rule of law and draw on the legal mechanisms of regional developm ent in other countries. To this end, it must establish a development mechanism c ompatible with the rule of law, perfect the market economic legal system in the West, so as to organically combine the macro-control with the market mechanism, adjust various interest relationships through law in order to create a situation of coordinated development under a unified leadership, protect and build up the ecological system in accordance with the law to achieve sustainable development , and implement the strategy of rejuvenating the country with the development of science and education in order to establish a sound mechanism of self-developme nt in the western region. Meanwhile, China must establish the basic legal norms for the development of the West and gradually reform the relevant legislative sy stem, judicial system and mechanism of legal services.
