网络环境下版权合理使用问题研究

摘　　要：通过对传统环境下版权“合理使用”产生的哲学、宪法学、经济学基本原理和传统技术条件下对版权人的影响程度及司法水平的分析 ,研究了网络环境下 ,数字化作品及网络传输方式对传统版权“合理使用”的冲击 ,根据WIPO两个国际条约的精神 ,提出变革只适用于印刷时代的“合理使用”判断标准 ,网络环境下“合理使用”的标准应从使用目的、被使用作品的性质、被使用部分的量和质同整体的关系。By analyzing the judicatory level and the influence on the copyright person under the conditions of the philosophical, constitutional and economic basic principles and conventional technology generated from the doctrine of “fair use” of copyright legislated in the conventional environment, the paper deals with the impact of the digitalized works and network transfer mode on the 'fair use' of the conventional copyright in the network environment. From the spirit of the two international treaties of WIPO, a proposal has been made on the change of the judgment criteria of the “fair use” only suited to the needs of the printing era. It is pointed out that the criteria for the “fair use” in the network environment should be re-considered from the four factors such as the purpose of use, nature of the copyrighted works used, the amount and substantiality of the portion used in relation to the copyrighted works as a whole and the effect of the use upon the potential market on the value of the copyrighted works.
