关于电子文件作为合法证据的法律可采性

摘　　要：文章通过回顾过去对缩微胶片、照片复制件和书面文件 (writtendocument)法律地位的探讨 ,对最近有关电子文件的性质及其法律证据价值的争论作了反思。作者认为目前的法律思想遵循着这样一个历史趋势 ,即从信赖证人证词和“可靠的社会背景”发展到相信书面文件的真实性和有效性。Through reviewing the previous exploration of legal status of microminiaturazation films, photocopies and written documents, this article reconsiders the recent arguments on the nature and the value of legal evidence. The author thinks that the historical trend observed by present legal thoughts is developing from counting on the witness, testimony and 'reliable social background' to having faith in the reality and effectiveness of written documents. It emphasizes the important significance in establishing the legal status of electronic documents in the document managing procedure.
