摘　　要：制约权力与保障权利是中国法制现代化的两个努力方向。本文从哲学的角度探讨了制 约权力与保障权利之间的相互关系，并从民主政治、市场经济和依法治国方略三个方 面论证了制约权力与保障权利的现实意义。Restricting powers and ensuring rights are two orientations on modernization of Chinese legal system to strive．In the article,the interrelation on the two aspects is looked into from philo－sophical angles． The practical signification of the two is expounded and proved in democratic politics,market economy and administering a nation by law．
