摘　　要：在对法国、德国等大陆法系国家民法典及普通法、斯堪的纳维亚法有关侵权行为一般性规定的模式进行比较分析后得出的结论是 ,在民法典中规定侵权行为法一般条款的立法模式更为可取。作者试拟了我国未来民法典侵权行为法一般条款 ,并对该草拟的条文进行了详细说明。By comparing and analyzing the civil code and common law of France, Germany and other countries with the continental legal system, and the general provisions of Scandinavian law of tort, it is concluded that it is more appropriate to enact the general clause of tort in civil code. The author articulated with explicit explanation the general clause of tort in the coming civil law of China.
