摘　　要：关于继承权能否成为侵权法保护的对象 ,理论界并不统一。本文针对“否定说”,从继承权的性质、开始的时间、内容、侵权法构成要件以及法理等五个方面与之商榷 ,并认为继承权应属侵权法保护的对象。As to whether the right of succession is the protection target of tort law,no agreement has been reached in the theoretical circle.In opposition to “the theory of negation”,gives a detailed discussion and comes to a conclusion that the right of succession should be the protection target of tort law,in terms of the nature of the right of succession,its starting point,its contents,the fundamental constitutes of tort law,and the jurisprudence.
