摘　　要：监管、创新、再监管是金融监管法中监管与创新的辩证规律。在金融业务综合化下 ,针对既存监管所面临的法律挑战 ,应进行有效监管 ,从国内法与国际法的角度对此内容进行理性的法律设计 ,确立功能型监管优先、内控优先化与法制化等法律制度。According to the dialectical rule of financial innovation & supervision, the article put forward the concept of effective supe rvision concerning the comprehensive financial business. On the basis of this, t he writers have conducted reasonable legal construction from the angle of domest ic law & international law, and also advanced the following opinions: priority o f functional supervision, the legalization of inner control & the expansion of t he last resort, etc.
