摘　　要：《医疗事故处理办法》及其实施细则和《民法通则》都是适用医疗事故赔偿案件的法律依据 ,如果确立了医患双方是医疗合同关系 ,《消费者权益保护法》、《合同法》Malpractice Regulations, its rules of implementation and General Rule of Civil Law are all applicable law basis for compensation cases caused by malpractice. If doctor and patient are established to be contract relationship of medical service, Consumerism Law and Contract Law also are law basis.
