摘　　要：新《婚姻法》根据我国婚姻发展的新情况,新增离婚无过错方有权提出损害赔偿制度,填补了我国立法这方面的空白,为无过错方保护自己的合法权益提供了法律依据。In accordance with new conditions of the marriage development in china,it is added newly to《New Marriage Law》 the system that the side with out faults has the authority to raise the compensation for damages ,which fills in the gaps concerned,and provides legal basis for the side to protect his or her legitimate rights and interests
