摘　　要：当前我国法治建设的前提应是法治观念的确立,在价值认证和目标确立的基础上探索法治国家的发展道路,避免实践中对法治的歧义理解。从法哲学的角度分析人性缺陷是人类选择法治的根源。法治以法律至上为基础,以权力制约为核心,以权利保障为目标。the precondition of rule of law is the estabishment of the concept of constitutionality trying to find the way of development of constitutional country on the basis of legalization of value and build of goal , obviating the misunderstanding of rule of law. This paper analyses that the humanistic defect is the ori-gin of the human's option of constitutionality from the angle of law philosophy, and discribes the basic object and inter value of rule of law.The basic of rule of law is supremacy of law, the vitals of it is restriction of power, and the guarantee of power is the goal of it. The essential rule of law must embodys this three respects value.
