摘　　要：道路交通事故损害赔偿责任 ,在《民法通则》和《道路交通事故处理办法》中分别都有规定但是两者的规定不尽相同。文章对这两部法律、法规中关于道路交通事故损害赔偿责任的构成要件进行了分析 ,阐述了实践中如何具体适用这两部法律。The damage compensation responsibility for road accidents is respectively stipulated in Civil Law Announcement and ways to Handle Road Accidents, but not quite same. This essay analyses the components of the damage compensation responsibility for road accidents in both laws and makes a esposition on how to apply them in practice .
