摘　　要：本文对入沪指定通道动物卫生监督执法中关于主体资格、事实认定与法律适用和执法程序等方面存在的困惑进行分析。主体资格方面:执法主体应明晰与有关执法部门的职权边界,依法履行动物卫生监督职责,案件查办中应清晰认定违法行为人;法律适用方面:应依据调查实证确定执法案由,对违反《动物防疫法》《上海市动物防疫条例》的违法行为准确定性,确保法律规范适用准确;执法程序方面:应区分简易程序和一般程序简易化操作行为,合理处置非因动物疫病造成的途亡动物,慎重实施动物(动物产品)入沪劝退以及通过微信、支付宝等新型支付手段收缴罚款行为。以期上述思考对官方兽医依法开展监督执法活动提供参考。In this article, some problems concerning animal health supervision and law enforcement towards the specified channels of Shanghai were analyzed, such as qualification of subjects, the affirmation of facts, application of law and law enforcement procedures. According to the analysis, in terms of subject qualification, the law enforcement subjects should explicitly distinguish their enforcement functions with other authorities, perform their animal health supervision duties according to law and clearly identify the illegal persons during case investigation. In terms of application of laws, law enforcement subjects should ascertain the title of administrative case according to proofs, accurately determine the nature of the behaviors violating the Animal Disease Prevention Law and Regulation on Animal Disease Prevention in Shanghai, make sure that the application of law was fight. In terms of law enforcement procedures, law enforcement subjects should distinguish the simple procedure with the simple operation of the general procedure, reasonably treat the animals not dying of animal diseases, cautiously persuade carriers to quit transporting animals or animal products into Shanghai and cautiously collect the fines through Wechat, Alipay and other new payment means. The above thoughts would provide guidance for the official vetefinarians to conduct supervision and law enforcement according to law.
