全面依法治国基本方略下的权力规制——兼论习近平法治思想中的权力制约思想

摘　　要：十九大将"坚持全面依法治国"作为新时代坚持和发展中国特色社会主义的基本方略之一,标志着习近平法治思想已经体系化并成为中国特色社会主义法治理论的核心和灵魂,是我们认识和把握法治中国建设理论与实践的目标取向和基本准则。建设法治中国必须坚持依法治国、依法执政、依法行政共同推进,逻辑上是因为唯有如此才能全面有效规制党和国家公权力。有效实现权力规制,首先要全面提升党和国家机关及其公职人员运用法治思维和法治方式分析和解决问题能力,推进国家治理体系和治理能力现代化;其次,要严格遵循宪法至上、尊法为先的法治原则,由此实现党的领导、人民当家作主与依法治国的有机统一;最后,必须"把权力关进制度的笼子里",确保权力行使主体、权力内容与范围以及行使程序符合既定的法律制度并在设定的体制机制内运转。Adhering to the rule of law in a comprehensive way has been determined as one of the fundamental strategies by the19 th CPC National Congress for upholding and developing socialism with Chinese characteristics in the new era. It marks that Xi Jinping’s thought of rule of law has been systematized and becomes the core and soul of the socialist rule of law theory with Chinese characteristics. It is our goal and basic principle to understand and grasp the theory and practice of the rule of law in China. To build the rule of law, China must adhere to the rule of law, govern according to law, and administrate according to law. Logically, it is only because of this that the party and state public power can be fully and effectively regulated. To effectively realize the regulation of power, we must first comprehensively improve the ability of the party and state organs and their public officials to analyze and solve problems using the rule of law thinking and the rule of law, and promote the modernization of the national governance system and governance capacity. Secondly, it is necessary to strictly abide by the principle of the rule of law, which is supreme of the Constitution and respects the law, thereby realizing the organic unity of the party’s leadership, the people being the masters of the country and the rule of law; finally, it is necessary to "put power into the cage of the system". Ensure that the power exercise subject, the content and scope of the power, and the exercise procedures conform to the established legal system and operate within the established institutional mechanisms.
