摘　　要：离婚救济制度是法律为因离婚受到损害或生活出现困难的一方提供的救济措施。为解决现行法存在的救济范围窄和适用难的问题,民法典婚姻家庭编应当在延续现有救济框架的基础上,依托家事审判制度的改革,重新构建以夫妻财产分割为主,以离婚经济补偿为辅,以经济帮助为兜底的离婚救济体系。The divorce relief system refers to remedies provided by the law to the party who got damaged from divorce or whose life became difficult in divorce. In order to solve the problem of narrow scope and difficult applying of the current law relief,Marriage and Family Copy in Civil Code should be based on the continuation of the existing relief framework,relying on the reform of the family trial system. The divorce relief system should be reconstructedwith the mainstay of division of marital property,the supplement of economic compensation for divorce and fallback provisions of economic assistance.
