互联网信息内容监管执法的难题及其破解

摘　　要：随着互联网深入发展,互联网信息内容呈现规模海量化、传播高速化和形式多样化特点,加大了互联网治理难度。对此,我国必须加强互联网信息内容监管执法,使互联网信息内容制作、传播、使用和管理符合法治要求,维护国家安全,推进国家网络治理现代化。当前互联网信息内容监管执法面临五大难题:法律问题、体制问题、机制问题、能力问题和环境问题。破解这些难题,我国要健全相关法律制度,夯实执法法律依据;改革监管执法体制,构筑合理体制支撑;完善监管执法机制,确保执法顺利高效;加强监管执法能力建设,强化执法人力技术支持;推进网络综合治理,营造良好执法环境。With the development of internet technology, internet information content presents the characteristics of large-scale quantification, high-speed transmission and diversification of forms, which increases the difficulty of internet governance.In this regard, China must strengthen the supervision and enforcing law on internet information content , make the production, dissemination, use and management of internet information content meet the requirements of the rule of law, and safeguard national network security, promote the modernization of national network governance. At present, there are five major problems in the supervision and enforcing law on internet information content, they are legal issues, institutional issues, mechanism issues, team issues, technical issues and environmental issues.To solve these problems, China should improve the relevant legal system,provide legal basis for enforcing law; reform system of supervision and enforcing law,build reasonable institutional support; improve mechanism of supervision and enforcing law , ensure smooth and efficient of supervision and enforcing law; strengthen the construction of enforcing law team,intensify the support of enforcing law manpower; innovate the technical means of supervision and enforcing law,enhance enforcing law ability guarantee; build a network culture of rule of law, and create a good environment for enforcing law.
