摘 要:探讨雇员犯罪情形下雇主替代责任的认定标准,提出"基础关系牵连说";对裁判观点进行比较法的理论分析,明确如何判断不同案型中雇主是否承担替代责任,总结出雇主替代责任承担的普适性规则;借鉴英美法系的医疗替代责任理论和判例,尝试在雇主替代责任制度中引入表见代理理论,并通过对我国雇主替代责任的理论争议和实践矛盾的分析,提出替代责任归责原则及责任承担方式的制度设计建议。This paper analyzes the identified standards of the employer vicarious liability in the case of employee crime,and puts forward the "basic relationship relevance theory". The paper makes a comparative law analysis of the judgment point of view,clarifying how to judge whether the employer should bear the vicarious liability in different cases,and tries to summarize the universal rules of the employer vicarious liability. At the same time,this paper tries to introduce the theory of apparent agency into the system of employer vicarious liability by drawing lessons from the theories and repudiations of medical vicarious liability in Anglo-American law system. This paper puts forward some suggestions on the system design of the principle of vicarious liability imputation and the mode of responsibility undertaking by analyzing the theoretical arguments and practical contradictions of employer vicarious liability in China.
