摘　　要：《中华人民共和国民族区域自治法》第14条是民族自治地方建立、撤销、变动的程序依据和民主保障条款,其关涉民族区域自治制度的根基。但该条文在规范层面、实践层面及法律体系层面均存在诸多问题,甚至可能危及宪法所确立的民族区域自治制度,需要在宪法的框架下进行修改、整合与完善。Article 14 of the Law on Regional Ethnic Autonomy is the safeguard clause of the basis of the system of regional ethnic autonomy. But this provision has many problems in norms and practice,even endangering the system of regional ethnic autonomy established by the constitution. This provision needs to be modified and integrated under the framework of constitutional democracy.
