摘 要:本文对我国高校学生惩戒制度实施中的三个主要问题展开历史梳理和分析。论文认为,高校学生惩戒应处理好教育与惩戒的关系,对违纪的学生并非一定要给予处分;惩戒实施应关注程序的正当合理,正确把握"陈述与申辩"的含义;完善惩戒救济机制,保障学生申诉机构的独立性,加强其裁决能力,明晰申诉与信访、监察等其他校内救济方式之间的区分与衔接。The paper analyzes three main issues in the implementation on the discipline systemof university students in China. First,the relationship between education and discipline must be dealt with well while making disciplinary decisions.And disciplinary actions against students who violate the discipline are not always to be taken.Second,in the process of student discipline,attentions should be paid to proper and reasonableprocedures and it is important to grasp the meaning and essence of "statement and defense". Third,the disciplinary remedy mechanism is supposed to be improved.Student appeal agencies must stay its independence and strengthen its adjudicating ability.And there should be clear clarifications of distinctions and connections between the way of appeal and other relief ways on campus,such as the complaint reporting and the supervision,etc.
