摘 要:随着转基因技术得以不断创新和研发,被较为广泛的应用于粮食生产中,商业化的转基因植物种植技术有效的解决了全球粮食的短缺问题。但是,转基因技术所涉及的知识产权问题,成为现阶段植物转基因研究者不可回避的问题。本研究基于法律保护视角,针对转基因的植物知识产权,现阶段所存在的主要问题,汲取发达国家的保护成功案例经验,从而构建转基因植物知识产权的法律保护理念及相应机制。为中国的转基因植物知识产权保护,提供可参考依据。With the continuous innovation and research & development, transgenic technology is widely applied in food production. Commercialized transgenic planting technology effectively solves the global food shortage problem. However, intellectual property problem involved in genetically modified technology has become an inevitable problem for genetically modified plant researchers at this stage. This study, based on the perspective of legal protection, aimed at the intellectual property rights of transgenic plants and the main problems existing at the present stage, and learned from the experience of successful protection cases in developed countries to construct the legal protection concept and corresponding mechanism of intellectual property rights for transgenic plants, which could provide references for the intellectual property protection of transgenic plants in our country.
