摘　　要：习近平全面依法治国思想的历史底蕴源于应然的法治,即以国家制定或者认可的"良法善治",强调法律至上、民主政治、权力制约和人权保障。它是一套蕴含原则、价值、制度和行动等多要素的理论和实践系统;习近平全面依法治国思想的时代特色则是以党的"四个全面"战略布局为核心,坚持党对法治的全面领导,实现宪法之治,国家法律与党内法规的有机结合、法治与德治有机结合之治,倡导社会自治和善用统筹综治,从而让权力依法运行,有效释放社会活力,保障我国现行宪法赋予公民的基本权利和"中国梦"均得以实现的富民强国之治。它是实然的法治,是对近、现代法治理论的重大发展。Xi Jinping's thoughts on comprehensively advancing law-based governance of China originated from the factual status of rule of law,which is the "good law and good governance"formulated or recognized by the state, emphasizing the supremacy of law,democratic politics,power restriction and human rights protection.It.is a set of theoretical and practical systems that contain multiple elements such as principles,values,institutions,and actions.The flow direction of Xi Jinping's thoughts on comprehensively advancing law-based governance of China is based on the realization of the party's Four-Pronged Comprehensive Strategy layout.The party's rule of the rule of law,the realization of the constitution,the combination of the'law of the state and the internal laws of the party,the combination of the rule of law and the rule of virtue,the promotion of social autonomy and the use of comprehensive management,so that the p'ower operates according to law,effectively release the vitality of society,and ultimately guarantee the basic rights of.citizens under the current Constitution and the rule of enriching the people and strengthening the country that the Chinese Dream can be realized.It is a real rule of law and a major development of the modern rule of law.
