摘　　要：党的十八大以来,全面依法治国与全面从严治党相继被纳入中国特色社会主义事业的战略布局中,党的十九大报告中再次强调了依法治国与从严治党作为国家基本方略的重要性,表达了以零容忍态度惩治腐败的决心。当前,弥除贪墨与构筑人民法之信仰相辅并进,关键在于斧正量刑。量失之衡,刑失之谬,如千里堤坝溃于蚁穴,法之公平不复矣。因而,均衡量刑不仅是法之公平由理念转化为现实的重要桥梁,更能促进腐败犯罪的法治防控。运用SPSS社会科学统计软件对于所收集的600份贪污、受贿犯罪的判决文书所载的量刑情节及结果进行统计分析,得出目前我国贪贿犯罪量刑存在失衡现象,进而总结导致失衡的原因,最后根据上述原因提出有针对性的对策,助力新时代背景下腐败犯罪的治理。Since the eighteen Party's Congress,comprehensively administering the country according to law and the strictly administering the party have been incorporated into the strategic layout in socialism with Chinese characteristics.General Secretary Xi Jinping emphasized once again the importance of ruling the country by law and strictly administering the party as the basic strategy of the country,and expressed the determination to punish corruption with no tolerance.At present,the key to eliminating corruption and building up the people's law is to correct sentencing.The slight negligence may lead to great disaster,If measurement of penalty lose balance,the punishment will be wrong,the law will not be fair again.Therefore,balanced sentencing is not only an important bridge to transform the balanced law from idea to reality,but also promoting the prevention and control the corruption.Using SPSS social science statistical software to carry out statistical analysis on the sentencing circumstances and results contained in the 600 judgments on corruption and bribery crimes,it is concluded that there is an imbalance in the sentencing in China,and summarize the causes of imbalances,then propose targeted countermeasures to help the governance of corruption crimes in the new era.
