摘　　要：姓名权作为一种人格权,在无需行政登记的情况下通常可任意行使。但公民的姓名要进入户籍登记系统并纳入行政管理时,则要充分考虑姓名所具有的符号、文化、经济、教化等外部性表现,平衡权利满足与秩序维护之间的关系,须受到行政机关的限制,包括公民称姓和取名的限制,约束公民合法、合理、有序地行使姓名决定权。As a personality right,name right can usually be exercised arbitrarily without administrative registration.However,when a citizen's name enters the household registration system and is included in the administrative management,it must fully consider the external expressions of the symbol,culture, economy,and education,and balance the relationship between rights satisfaction and order maintenance.The restrictions include the surname and name,and the citizens'right to exercise their name in a legal,reasonable and orderly manner.
