摘　　要：继续盘问制度的适用条件是指人民警察在主观认知上达到"理性人"对相对人的合理怀疑,并且当场无法释疑。对实际应用中出现的混淆继续盘问与传唤、拘留、拘传等强制措施的适用、扩大继续盘问对象范围、错误适用继续盘问时限以及继续盘问制度空置化情况严重等问题,应当加强相应的培训和学习,提高程序意识和人权意识,加强监督和检查以提高认识。The applicable conditions for continued interrogation system refer to the fact that the police have the reasonable subjective doubts as "rational people"to the private party and cannot be dismissed on the spot.In practical applications,Confusing the application of compulsory measures between continued interrogation,subpoena,detention and criminal summon,expanding the scope of continued interrogation object,applying the time limit falsely and the serious vacancy of continued interrogation arise,we should strengthen corresponding training and learning,improve procedural awareness and human rights awareness,and strengthen supervision and inspection.
