摘　　要：网络赌博犯罪是依托于互联网技术发展而衍生的一种新兴犯罪形式,其与传统赌博犯罪相比较,拥有主体隐蔽、犯罪成本低等特点。对于网络赌博犯罪,不仅要明确其概念,更要解决罪与非罪、"开设赌场"等司法认定问题。基于网络赌博犯罪的特殊性,应增设网络赌博罪,进一步完善刑事立法。Online gambling crime is a new form of crime derived from the development of Internet technology.Compared with traditional gambling crimes,it has the characteristics of hidden subject and low crime cost.For online gambling crimes,it is necessary not only to clarify its concept,but also to solve the problem of judicial determination such as sin and non-crime and "opening a casino".Based on the particularity of online gambling crimes,online gambling crimes should be added to fur-ther improve criminal legislation.
